PLAYER REPRESENTATION AGREEMENT

(hereinafter referred to as the “Agent”)
AND
Mr. Carlos Ohene
Date of Birth: 21 July 1993 • Place of Birth: Accra, Ghana
Nationality: Ghana • Passport No.: G2450170
(hereinafter referred to as the “Player”)
PREAMBLE
This Agreement is concluded in accordance with the FIFA Football Agent Regulations (FFAR 2023). The Agent is duly licensed by FIFA and entitled to represent Players in employment-related and transfer-related matters.
ARTICLE 1 – SCOPE OF REPRESENTATION
The Player appoints the Agent as his exclusive representative for all employment and transfer negotiations with professional football clubs during the term of this Agreement.
- Negotiation and conclusion of employment contracts with clubs;
- Negotiation and conclusion of transfer agreements between clubs;
- Endorsement, sponsorship and commercial agreements only if expressly authorized in writing by the Player.
ARTICLE 2 – TERM AND RENEWAL (PERFORMANCE-BASED)
This Agreement commences on the date of signature and remains valid until 01 March 2026, unless terminated earlier under Article 8.
Performance-Based Renewal (Three Stages):
- Stage 1 – Contract Conclusion: Agent facilitates the conclusion of a professional employment contract for the Player with a club.
- Stage 2 – Letter of Interest: Player receives an official Letter of Interest or written expression of intent from a club as a result of the Agent’s work.
- Stage 3 – Formal Offer: Agent secures an official contract offer, trial invitation, pre-contract or salary proposal from a professional club.
Any of the above outcomes shall trigger the option to extend this Agreement for up to two (2) additional years, upon mutual written confirmation by the parties and re-registration on the FIFA Agent Platform (FFAR Art. 11(5)). If none of the above occur during the initial term, this Agreement shall expire automatically on 01 March 2026.
ARTICLE 3 – REMUNERATION
The Player pays the Agent a commission of ten percent (10%) of gross income from any employment contract or transfer agreement resulting from the Agent’s services. Payments shall follow FIFA and national association rules and, where applicable, may be processed via the FIFA Clearing House. No payments shall be made to any third party. The commission is payable exclusively to the licensed Agent.
ARTICLE 4 – REGISTRATION
This Agreement shall be uploaded and registered on the official FIFA Agent Platform.
ARTICLE 5 – AGENT’S OBLIGATIONS
- Act in good faith and in the best interest of the Player;
- Avoid any conflict of interest, unless expressly permitted under FFAR;
- Comply with all FIFA, confederation, and national association regulations;
- Ensure complete transparency regarding all negotiations;
- Immediately inform the Player of all material developments.
ARTICLE 6 – PLAYER’S OBLIGATIONS
- Provide the Agent with all relevant information for negotiations;
- Cooperate fully and in good faith;
- Not engage any other agent for the same scope during the term of this Agreement;
- Immediately inform the Agent of all negotiation offers.
ARTICLE 7 – CONFIDENTIALITY
Both parties shall keep all negotiations and contractual terms confidential except where disclosure is required by law or FIFA regulations. This obligation survives termination.
ARTICLE 8 – TERMINATION
- By mutual written consent;
- For just cause, as defined by FIFA regulations;
- Upon expiry of the agreed term;
- For material breach after fourteen (14) days’ written notice without remedy.
Termination shall be notified in writing and registered on the FIFA Agent Platform.
ARTICLE 9 – DISPUTE RESOLUTION
Any dispute arising out of this Agreement shall be submitted exclusively to the FIFA Football Tribunal (Dispute Resolution Chamber). Appeals may be lodged with the Court of Arbitration for Sport (CAS), Lausanne, Switzerland. All decisions are final and binding.
ARTICLE 10 – GOVERNING LAW
This Agreement is governed by the regulations of FIFA and, subsidiarily, by the laws of Switzerland.
ARTICLE 11 – MISCELLANEOUS
- Severability: If any provision is held invalid, the remaining provisions remain valid.
- Entire Agreement: This Agreement constitutes the entire agreement and supersedes prior arrangements.
- Written Form: Amendments require written form and must be registered on the FIFA Agent Platform.
- Language: In case of translations, the English version prevails.
